These Terms and Conditions govern your use of the Buan platform (“Buan”, “we”, “our”, or “us”).

By accessing or using Buan, you agree to be bound by these Terms.

Buan is an online ordering platform that enables customers to place orders with independent businesses. Buan provides the technology that connects customers and businesses but does not manufacture, prepare, sell or deliver products unless expressly stated.

Buan acts solely as a technology platform and intermediary.

The contract for the purchase of any goods or services is formed directly between the customer and the business fulfilling the order.

The business is solely responsible for:

• the products it sells
• food quality and safety
• ingredients and allergens
• pricing
• availability
• preparation
• packaging
• fulfilment
• delivery (where applicable)
• compliance with all applicable laws and regulations.

Buan is not the seller or supplier of the products purchased through the platform.

You agree that any information you provide is accurate and up to date.

You are responsible for maintaining the security of your account and password.

You must be at least 18 years old to create an account or place orders for age-restricted products.

When you place an order through Buan:

• you are making an offer to purchase directly from the business
• the business decides whether to accept or reject the order
• once accepted, a legally binding contract exists between you and the business.

Buan is not responsible if a business cannot fulfil an order due to stock shortages, staffing issues or operational difficulties.

Payments are processed securely by third-party payment providers.

Buan does not store your payment card details.

Where Buan collects payment on behalf of a business, it does so solely as the business’s payment agent.

Businesses are responsible for setting:

• menu prices
• delivery charges
• service charges
• promotions
• discounts
• product descriptions.

Prices may change without notice.

Businesses are responsible for providing accurate allergen and ingredient information.

Customers with allergies or dietary requirements should contact the business directly before placing an order.

Buan accepts no responsibility for inaccurate allergen information supplied by businesses.

Estimated collection or delivery times are estimates only.

Delays may occur due to traffic, weather, demand or operational issues.

Buan does not guarantee delivery times.

Risk in the goods passes to the customer when the order is collected or delivered.

Questions regarding food quality, missing items, incorrect orders or product quality should first be raised directly with the business.

Where appropriate, Buan may assist in facilitating communication between customers and businesses but is not obliged to resolve disputes.

Refunds remain the responsibility of the business unless required otherwise by applicable law.

Businesses using Buan warrant that they:

• hold all required licences and registrations
• comply with UK food safety legislation
• comply with allergen legislation
• comply with consumer protection law
• maintain appropriate insurance
• fulfil orders professionally and lawfully.

Businesses agree to indemnify Buan against losses arising from their breach of these obligations.

Users must not:

• misuse the platform
• attempt to interfere with the service
• submit fraudulent orders
• upload unlawful content
• infringe intellectual property rights.

We may suspend or terminate accounts that breach these Terms.

We aim to keep Buan available at all times but do not guarantee uninterrupted service.

We may suspend the platform for maintenance, updates or emergency work.

Nothing in these Terms excludes liability that cannot legally be excluded under the laws of England and Wales, including liability for death or personal injury caused by negligence or for fraud.

Subject to the above, Buan shall not be liable for:

• food quality
• product safety
• allergic reactions
• incorrect orders
• missing items
• late deliveries
• actions or omissions of businesses
• indirect or consequential losses
• loss of profits
• loss of business
• loss of goodwill.

To the maximum extent permitted by law, Buan’s total liability arising from your use of the platform shall not exceed the total service fees paid by you to Buan in relation to the relevant order.

All intellectual property rights in the Buan platform remain the property of Buan or its licensors.

You may not copy, modify or redistribute any part of the platform without permission.

Your personal information is processed in accordance with our Privacy Policy.

By using Buan, you consent to such processing.

We may amend these Terms from time to time.

The latest version will always be published on our website.

Continued use of the platform constitutes acceptance of the revised Terms.

These Terms are governed by the laws of England and Wales.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
